Terms of Service

1. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. You are responsible for your actions and for any content you submit. Do not attempt to disrupt, reverse engineer, or misuse the Service.

2. Accounts & Security

You may need an account or Scotty Code to use certain features. Keep your credentials confidential and notify us immediately of any suspected unauthorized use. You are responsible for all activity under your account.

3. Scotty Codes

A Scotty Code is a unique identifier that unlocks Pro features across the OVRTK mobile app and ChatGPT. Codes are non-transferable and tied to your subscription. Sharing codes may result in termination of service.

4. Subscriptions, Billing, & Refunds

Scotty Pro is offered via paid subscription at $7.99/month. Web purchases are processed through Stripe. Mobile app purchases are billed through the respective app stores.

• Billing & Renewals: Subscriptions renew automatically until canceled.
• Trials: If a free trial is offered, you may be charged when the trial ends unless you cancel first.
• Refunds: Refunds are handled per our Refund Policy. For app store purchases, contact Apple or Google directly.

5. Free Tier Limitations

The free tier includes 10 messages per day and 3 image analyses per day. These limits reset daily at midnight UTC. We reserve the right to modify free tier limits at any time.

6. Prohibited Conduct

• Violating laws or infringing third-party rights
• Uploading malicious code or attempting to gain unauthorized access
• Scraping, bulk exporting, or using automated means not explicitly permitted
• Sharing Scotty Codes or reselling access
• Posting illegal, harassing, or otherwise harmful content

7. AI Disclosures & Limitations

Scotty is an AI assistant. Scotty's responses are generated output and may be inaccurate, incomplete, or outdated. They are provided for informational purposes only and are not a substitute for professional advice or hands-on inspection.

Always verify torque specs, fitment, and safety-critical details with manufacturer manuals and qualified professionals. You are responsible for how you use the information.

8. Third-Party Services

The Service may link to or rely on third-party services (e.g., Stripe, ChatGPT, app stores). We do not control third-party services and are not responsible for their content or practices. Your use of them is governed by their terms and policies.

9. Intellectual Property

The Service, including its software, design, logos, and content (excluding your content), is owned by RWX-TEK INC. or its licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RWX-TEK INC. AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US (IF ANY) FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

12. Indemnification

You agree to defend, indemnify, and hold harmless RWX-TEK INC. and our affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate access to the Service at any time if we believe you have violated these Terms or if necessary to protect the Service or other users. You may stop using the Service at any time. Certain provisions (e.g., intellectual property, disclaimers, limitations of liability) survive termination.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Venue for any disputes shall be in the state or federal courts located in Los Angeles County, California, unless applicable law requires otherwise.

15. Changes to These Terms

We may update these Terms to reflect changes to our Service or legal requirements. We will post the updated version with a new "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance.
