Terms of Service

1. Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. You are responsible for your actions and for any content you submit. Do not attempt to disrupt, reverse engineer, or misuse the Service.

2. Accounts & Security

You may need an account to use certain features. Keep your credentials confidential and notify us immediately of any suspected unauthorized use. You are responsible for all activity under your account.

3. Push Notifications

By enabling push notifications, you agree to receive messages from OVRTK including:

• Build Reminders: Notifications about your vehicle builds and maintenance
• Scotty AI Responses: When our AI assistant responds to your questions
• Daily Check-ins: Optional daily engagement messages (3pm local time)

All notifications are optional and can be individually controlled in the app's Profile → Preferences screen. You may disable notifications at any time through the app settings or your device settings. We will not send promotional or marketing notifications without your explicit consent.

4. Subscriptions, Billing, & Refunds

Some features (e.g., OVRTK Plus, Track Mode, Club) are offered via paid subscriptions ("Subscription"). Purchases on iOS and Android are billed through the respective app stores. Pricing and terms are displayed at the point of purchase and may change with prior notice where required.

• Billing & Renewals: Subscriptions renew automatically until canceled in your app-store account settings, typically at least 24 hours before the renewal date.
• Trials: If a free trial is offered, you may be charged when the trial ends unless you cancel first.
• Refunds: Refunds are handled by Apple App Store or Google Play per their policies. Contact the store directly for refund requests.

5. User Content

You retain ownership of content you submit (e.g., car profiles, photos, notes). You grant OVRTK a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit your content as needed to operate and improve the Service. You are responsible for ensuring you have the rights to the content you upload.

6. Prohibited Conduct

• Violating laws or infringing third-party rights
• Uploading malicious code or attempting to gain unauthorized access
• Scraping, bulk exporting, or using automated means not explicitly permitted
• Posting illegal, harassing, or otherwise harmful content

7. AI Disclosures & Limitations

OVRTK includes an AI assistant ("Scotty"). Scotty's responses are generated output and may be inaccurate, incomplete, or outdated. They are provided for informational purposes only and are not a substitute for professional advice or hands-on inspection. Always verify torque specs, fitment, and safety-critical details with manufacturer manuals and qualified professionals. You are responsible for how you use the information.

To provide AI functionality, we may send prompts and limited context to model providers acting on our behalf; see our Privacy Policy for details.

8. Third-Party Services

The Service may link to or rely on third-party services (e.g., app stores, hosting, analytics). We do not control third-party services and are not responsible for their content or practices. Your use of them is governed by their terms and policies.

9. Intellectual Property

The Service, including its software, design, logos, and content (excluding your content), is owned by OVRTK or its licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVRTK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US (IF ANY) FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE.

12. Indemnification

You agree to defend, indemnify, and hold harmless OVRTK and our affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate access to the Service at any time if we believe you have violated these Terms or if necessary to protect the Service or other users. You may stop using the Service at any time. Certain provisions (e.g., intellectual property, disclaimers, limitations of liability) survive termination.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Venue for any disputes shall be in the state or federal courts located in Los Angeles County, California, unless applicable law requires otherwise.

15. Changes to These Terms

We may update these Terms to reflect changes to our Service or legal requirements. We will post the updated version with a new "Last updated" date. If changes are material, we will provide additional notice as appropriate. Your continued use of the Service after changes become effective constitutes acceptance.
